Who is responsible for processing your personal data?
ESTUDI JURÍDIC BADIA SLP is responsible for processing the USER’s personal data and informs you that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD).
Why do we process your personal data?
To maintain a commercial relationship with the USER. The operations planned for processing are:
• Sending commercial advertising communications by email, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that enables commercial communications. These communications will be made by the RESPONSIBLE and are related to its services, or those of its collaborators or suppliers, with whom it has reached a promotional agreement. In this case, third parties will never have access to personal data.
• Conducting market studies and statistical analysis.
• Processing orders, requests, responding to inquiries, or any type of request made by the USER through any of the contact methods available on the RESPONSIBLE’s website.
• Sending the online newsletter about news in our activity and information of interest to the USER.
• Customer relationship maintenance.
Types of USERS:
- Office clients: Identifying data of our clients.
- Newsletter subscribers: Email of physical and legal persons who have subscribed to our newsletter, as well as office clients.
- Others: Identifying data of people who have contacted our office by any means without having maintained a previous relationship.
Why can we process your personal data?
Because the processing is legitimized by Article 6 of the GDPR in the following ways:
• With the USER’s consent: sending communications and the newsletter.
• For the legitimate interest of the RESPONSIBLE: conducting market studies, statistical analyses, etc., and processing orders, requests, etc., at the USER’s request.
• When necessary for the execution of a contract and to fulfill the obligations established in said contract.
• No profiling will be carried out, nor will automated decisions be made.
To whom do we disclose your personal data?
No communication of personal data to third parties is planned except for legal obligation or, if necessary for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the RESPONSIBLE has formalized confidentiality contracts and processing commission required by current privacy regulations.
How long will we keep your personal data?
They will be kept for no longer than necessary to maintain the purpose of the processing or as long as there are legal prescriptions dictating their custody. In this case, the data will be kept blocked until the end of the prescription period, then they will be deleted with the appropriate security measures to ensure their anonymization or the total destruction of the same.
If there is a contractual relationship with the USER, the retention period is ten years from the end of the contract. In the case of subscription to the newsletter, it will be three years from the date of revocation of consent.
What are your rights?
The rights of the USER are:
• The right to withdraw consent at any time.
• Right to:
— Access: the USER has the right to know the data.
— Rectification: the USER has the right to rectify or complete any data that is inaccurate or incomplete.
— Portability: the USER may obtain a copy of their data and, if technically possible, have them communicated to another controller.
— Deletion: the USER can request that their data be deleted from the RESPONSIBLE’s systems.
— Limitation: the USER may limit the way we process their data in the cases established by the GDPR.
— Opposition: the USER can oppose the processing of their data whenever this is possible.
• Right to file a complaint with the control authority (www.aepd.es) if you consider that the processing does not comply with current regulations.

Mandatory or optional nature of the information provided
The USER, by marking the corresponding boxes and entering data in the fields, expressly and freely and unequivocally accepts that their data is necessary to attend to their request by the RESPONSIBLE. The RESPONSIBLE will indicate which data are necessary to provide an optimal service to the USER. If these data are not provided, it is not guaranteed that the information and services provided are fully adjusted to your needs. The USER guarantees that the personal data provided to the RESPONSIBLE are true and is responsible for communicating any modification thereof.
Security measures
That, in accordance with the provisions of current regulations on personal data protection, the RESPONSIBLE is complying with all the provisions of the RGPD and LOPDGDD regulations for the processing of personal data for which it is responsible, and manifestly with the principles described in Article 5 of the GDPR, by which they are processed lawfully, fairly, and transparently in relation to the interested party and adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.
The RESPONSIBLE guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD to protect the rights and freedoms of the USERS and has communicated the appropriate information so that they can exercise them.
